The practice of Construction Law has exploded in recent years. A number of major California and national firms dedicate much or all of their practice to advising construction industry clients, litigating construction claims, and drafting or opposing construction-related legislation.
Construction defect litigation, especially, is burgeoning in California.
The number of California Superior Court complex litigation departments handling large residential and commercial construction defect matters in California is increasing from the original 6 that were authorized and funded by the Judicial Council to the point where there now seems to be one of these systems, or its analog, in virtually every major population center. While Orange County, San Diego, and the San Francisco Bay Area continue to be the busiest complex litigation venues, places like Bakersfield, Fresno, Sacramento, and San Joaquin Counties are rapidly catching up.
Because there are so many issues constantly at issue in the area of construction law --deal structuring, contract drafting/negotiation, delay, financing and mortgage issues, residential and commercial defect actions -- there is a need for some place where industry members, their counsel, and other interested persons to exchange information and ideas as they try to get their arms (and brains) around the problems they encounter.
That's why this site is being developed.
This site is intended to be a purely informal resource for persons interested in the construction industry and the technical/legal issues that surround and grow out of it. Anyone using this site acknowledges that the information in these pages is obtained from a wide variety of sources, not one of which is sufficiently reliable to use as the basis for a legal opinion or strategy without consulting an attorney of your choosing who is thoroughly skilled in the area of law you are investigating. No one here fits that bill, so don't ask.
We hope that users will browse the information already presented in the site and, as soon as it is possible (when the interactive segments are completed), contribute their own ideas in the feedback section, participate in on-line discussions, and post their own comments in the blog space. Ultimately, it is expected that this site will become a valuable place for airing ideas and testing theories, and generally promoting a better understanding of construction law and industry issues...but it is never intended that this space will be a place to obtain legal services of any kind, and any attempts to to so will be vigorously and gleefully rejected. We also don't provide referrals to attorneys. This is not a marketing site for attorneys or referral services, and will never become one, and the information on the site is not reviewed for accuracy - legal or otherwise.
If this isn't sufficient to discourage you from using information found here as part of a legal opinion or strategy, please read on.
